Terms of Service

1. Who we are

MRKTRS Ads is a service operated by MRKTRS Media ("we", "us"). These terms apply to the paid advertising management service described on this website and to your use of the website itself.

2. The service

We manage paid advertising for hair and scalp care ecommerce brands. The scope of work is described on the What's Included page. Anything outside that scope, including product photography, creator content and video production, is only provided if agreed separately in writing.

3. Fees

• A one-time setup fee of £150 is payable before onboarding begins.
• A management fee of £497 per month is payable in advance for each month of service.
• Advertising spend is not included in our fees. You pay the advertising platform directly and are responsible for the budget you set.
• Fees are non-refundable once the month of service has started, except where required by law.

4. Term and cancellation

There is no long-term contract. The service continues on a monthly basis until either party cancels. To cancel, give written notice by email before the next monthly billing date. Work already completed for the current month is not refunded.

5. Your responsibilities

• Provide accurate information about your business, products and previous advertising.
• Give us the access we need to your advertising accounts, website data and existing assets.
• Ensure your products, claims and content comply with the law and the advertising platform's policies.
• Fund your advertising account so campaigns can run.

6. No guarantees

We do not guarantee sales, revenue, return on ad spend or any specific result. Advertising performance depends on factors outside our control, including your product, pricing, website, market conditions and platform behaviour. We commit to the quality and consistency of the work described on this website.

7. Accounts and ownership

Advertising accounts remain your property. Ad copy, creative concepts and campaign structures produced for your account are yours to keep once the fees for the period in which they were produced have been paid. We may describe our general approach and anonymised learnings elsewhere, but we will not share your confidential data.

8. Confidentiality

Each party will keep the other's non-public information confidential and use it only for the purpose of the service.

9. Liability

To the extent permitted by law, our total liability arising from the service in any twelve-month period is limited to the management fees you paid to us in that period. We are not liable for advertising spend, lost profits or indirect losses.

10. Changes to these terms

We may update these terms. The version published on this page at the start of a billing month applies to that month.

11. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
